Terms of Service — ARfi™

Entity Responsible: HortSens Studio, a division of HortSens Technologies (“HortSens,” “we,” “our,” or “us”).

These Terms of Service (“Terms”) govern your access to and use of ARfi™ (the “App”), including any features, content, and services offered within it.
By downloading, installing, or using ARfi, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree, do not use the App.

1. Eligibility and Acceptance

You must be at least 13 years old (or the minimum legal age in your country) to use ARfi.
By using the App, you confirm that:

You meet the required age of eligibility.
You have read, understood, and agreed to these Terms.
If you are under 18, you have obtained parental or guardian consent to use the App.

If you are accepting these Terms on behalf of an organization, you represent that you are authorized to do so.

2. Description of the Service

ARfi™ is an augmented-reality (“AR”) application that allows users to explore, collect, place, and trade digital artworks anchored to real-world locations.
The App integrates artistic expression, exploration, and simulation elements to provide an immersive and educational experience.

ARfi is continually updated and may evolve through new features, designs, or content. Certain features may vary depending on your device and region.

3. Account Registration

Some features require creating an account. You agree to:

Provide accurate and current information during registration.
Maintain confidentiality of your login credentials.
Accept full responsibility for all activities under your account.

You must not share your account or allow others to access it using your credentials.

HortSens reserves the right to suspend or terminate accounts that violate these Terms or compromise security.

4. In-App Purchases

All in-app purchases, subscriptions, and digital content are processed solely through official App Store and Google Play billing systems.
By making a purchase, you agree to the respective platform’s payment terms and refund policies.
HortSens does not handle or store payment card data.

All transactions are final except where required by law or store policy.

5. User Conduct

You agree to use ARfi only for lawful purposes and in a respectful, safe manner.
You must not:

Violate any applicable laws or regulations.
Upload or display content that is illegal, defamatory, harassing, hateful, infringing, or obscene.
Interfere with the operation of ARfi or attempt to access data without authorization.
Use ARfi while operating a vehicle or in situations where distraction could cause injury.
Attempt to copy, modify, reverse engineer, or exploit the App’s software or assets.

We reserve the right to moderate, remove, or restrict any content or behavior that violates these Terms or harms the ARfi community.

6. User-Generated Content

ARfi allows users to create, upload, and place digital artworks, comments, and other content (“User Content”).

By submitting User Content, you grant HortSens a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, display, and distribute your content solely for:

Operating and improving the App; and
Showcasing community creations within ARfi and related promotional materials.

You retain ownership of your original creations.
You are solely responsible for ensuring that your User Content does not infringe on the intellectual property, privacy, or moral rights of others.

We may remove or disable access to User Content that violates these Terms, the law, or community standards.

7. Intellectual Property Rights

All rights, titles, and interests in ARfi — including software, graphics, artwork, design, and branding — are owned or licensed by HortSens Studio and are protected by international copyright and trademark laws.

You are granted a limited, non-transferable, non-exclusive, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You may not copy, distribute, modify, or create derivative works based on ARfi or its assets without prior written permission.

8. Safety and Location Use

ARfi uses device sensors and approximate location data to anchor digital artworks in real-world space.
You are responsible for your safety and surroundings while using AR features.
Do not enter private property, restricted zones, or unsafe environments while using the App.

HortSens is not responsible for accidents, property damage, or injuries arising from unsafe or distracted use.

9. Termination and Suspension

We reserve the right to suspend or terminate your access to ARfi, with or without notice, if:

You breach these Terms or applicable laws.
Your actions harm other users or the integrity of the service.
Required by regulatory or security reasons.

Upon termination, all rights granted to you under these Terms will immediately cease.

10. Disclaimer of Warranties

ARfi is provided on an “as is” and “as available” basis.
We make no warranties, express or implied, regarding:

The uninterrupted or error-free operation of the App;
The accuracy or reliability of content; or
The fitness of ARfi for any particular purpose.

You use the App at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, HortSens Studio, its affiliates, and employees shall not be liable for:

Any indirect, incidental, or consequential damages;
Data loss or unauthorized access; or
Personal injury or property damage resulting from misuse of the App.

Our total liability under any claim related to ARfi shall not exceed the amount you paid (if any) for access to the App within the 12 months preceding the incident.

12. Indemnification

You agree to indemnify and hold harmless HortSens Studio, its affiliates, employees, and partners from any claims, damages, losses, or expenses arising out of:

Your use or misuse of ARfi,
Your violation of these Terms, or
Your infringement of any rights of a third party.

13. Changes to the Terms

We may modify these Terms periodically to reflect updates to the App or legal requirements.
If we make material changes, we will notify users in-app or by email before the changes take effect.
Continued use of ARfi after such notice constitutes acceptance of the revised Terms.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction of HortSens Technologies’ registered headquarters, without regard to conflict-of-law principles.

You agree to submit to the exclusive jurisdiction of the courts in that jurisdiction for any disputes arising from or relating to ARfi.
